Evolution from agricultural production to non-agricultural production is the main line of social development, it is no doubt that the transfer of surplus rural labor force become a thorn problem in this historical course. With the development of China's Socialist Market Economy, the gradual loosening of urban household registration system, a large number of surplus rural labor force began to rush to the city, and formed a worker-peasant groups called migrant workers . They make a significant contribution to urban development, but also bring severe danger to the urban public security. As we all know, Chinese farmers always have been regarded to be hardworking and plain, most of them are law-abiding and honest. However, the illegal and criminal activities of migrant workers are common in recent years.Is the urban environment give birth to "migrant workers offender" or the migrant workers'unique "criminal gene" come into action? It puzzled me. Based on this confusion and concern of migrant workers, I decided to start my research about their crime looking forward to discovering the real reasons behind the crime of migrant workers.I referred to a large number of documents and data from networks and library collection before writing this article. From January 1999 to April 2010, there are a total of 125 papers in relation to crime of migrant workers on Chinese Academic Journals Online, 19 of which are published in core journals, 10 are excellent master's thesis. There are very few monographs about migrant workers'crime, most monographs relating to migrant workers only discussed from a sociological point of view, the crime of migrant workers were not involved. We can say that the theoretical study of migrant workers'crime is insufficient and is incompatible with the practice. Current researches on the migrant workers'crime primarily have the following shortcomings: first, they didn't clarify the difference between the floating population and the migrant workers, and even confused the two concepts. Second, the discussion about the phenomenon of crime was so generalized that there was no relevant data to support the research. Third, when it refers to the causes of crime and the countermeasures, the analysis was either too superficial or too limited. Finally, they failed to explain the crime of migrant workers from the particularity of such a group, instead, they only followed the theory of crime mechanically, Today, with increasing emphasis of academic research on the combination of speculation and positivism, the researches on the migrant workers'crime become gradually realistic, and play an important role in judicial practice.In order to avoid empty and boring generalities, I regard the crimes of migrant workers in Shanghai as the starting point. Through displaying and anglicizing a large number of data, I will show the current state of the migrant workers'crime visually. First of all, I discriminates the concept of migrant workers from their related concepts, and then analyzes the characteristics of migrant workers. Then I break through the limitation of the migrant workers'crime in Shanghai, study the reasons of the migrant workers'crime and countermeasures in the whole city from a grand vision. In addition, my article will integrate the criminological theory with the actual situation of migrant workers, explore the cultural causes of migrant workers'crime from the conflicts between the traditional country culture and modern urban culture, and then I will discuss the impact of mass media on migrant workers'crime from a deeper level. Finally, I put forward some preventive measures mainly in terms of the social policies.This paper comprises four parts:The first part defines the concept of migrant workers and clarifies the relationship between migrant workers and their similar concepts. Then it describes the characteristics of migrant workers. Finally, this part shows the situation of migrant workers in Shanghai with plenty of data.The second part produces a perceptual knowledge about the phenomenon of migrant workers'crime by discussing the migrant workers'crime in Shanghai from three aspects, including the numbers of crimes, criminal types, and criminal characteristics. The third part mainly discusses the causes of migrant workers'crime in the light of economy, social environment, and culture. Economic reasons related to such items as poverty, unemployment, poverty gap; social environmental factors include both discrimination and the mass media. When it refers to the discrimination, it includes discrimination in social systems, and employment policies and urban public discrimination. Public selective media coverage and bad information will also lead to the crime of migrant workers. Cultural reasons include the cultural conflict of the migrant workers which is called cultural collision between country and urban.The fourth part discusses the prevention measures of migrant workers'crime from the perspective of criminal sociology, specifically including the following three parts. First, the urban-rural dual structure must be changed, and construct the pattern of urban-rural integration. To achieve this goal, it involves the reformation about the household registration system, the social security system, and the establishment of unified labor market. Second, efforts should be made to improve the poor living conditions of migrant workers and protect their legitimate rights and interests. The government, trade unions and other non-governmental organizations will play an important part in protecting the legitimate rights and interests of migrant workers and provide guidance to ensure a proper and orderly movement of rural labor. Lastly, in order to make migrant workers integrate into urban society, the urban and rural opposition must be eliminated. These measures include the elimination of discrimination, the strengthen of mutual recognition between urban and rural culture, and the cultivation of a sense of belonging and identification to the city enjoyed by migrant workers.
