Study On The Legal Issues About Our Country's Government Service Procurement

In June 2002, the National People's Congress examined and adopted the Government Procurement Law of the People's Republic of China (GPLPRC) and it had already been implemented in January 1st,2003. GPLPRC, which provides a unified legal basis for government procurement, has great significance to the rapid and healthy development of government procurement, and takes paramount place in the history of Government Procurement law.However, this law there still are many imperfections, among goods, projects and service, the law doesn't make distinction between each other, and it couldn't also make corresponding regulations,as a result,.there still are many problems in government procurement. Our government has promised to sign the Government Procurement Agreement as early as possible in the process of entering WTO, and has already begun the negotiation of accession to the agreement in the end of 2007. It will be an opportunity and also a challenge.Services which is an important symbol of the country's economic development, plays a very important role in a country's economy. To government, encouraging and promoting of the government procurement services is an important measure to foster and support the development of services, and it is also the only way to improve the government procurement system. In this thesis, chapter two,three,four are connection with our country's Government Service Procurement market access issues,corruption and bribery issues and the public bidding problems.we has discussed some problems in our country's Government Procurement Law combining with the related regulations in international organizations and government procurement system. It is the key to the thesis on how to improve our country's related legislation and measures, on the base of the exited international rules and conventions, in order to meet the gradually opened government procurement market and the internationalization of the government procurement activities. The author will focus on the concept, specificity of government procurement, referring to the legislation of international organization government procurement, analysis the present legislation situation and problems of our country's government procurement, and then elaborate how to improve our country's government procurement system.
