Research On Current Analyses And Strategies On The Job-Related Crimes In The Judicial Realm In ChuZhou

Since the 90s of the 20th century, corruption has become the focal point of the most concern around the world. Job-Related crimes, as the main manifestations of corruption, is seen as a tumor in human social life, economic life, political life, and it greatly damages the social justice, undermines economic development, and corrodes the clean politics. In recent years, Chuzhou City, like any other cities in China, has a rapid economic development, but Job-Related crimes also showed a rising trend in the judicial field. Therefore, the analysis on the current situation of Job-Related crimes in the judicial realm in Chuzhou and the research on the corresponding Strategies have an important practical significance for promoting the economic and social development of Chuzhou.This paper briefly elaborates the concept of Job-related crimes and the legal characteristics, and analyzes the overall situation and the main features of Job-related crimes in the judicial realm of Chuzhou, for example, the subjects of crimes are mainly managers in work units and departments, the number of crimes is large, the time of crimes is long and the forms of crimes show public or semi-open gradually, the proportion of major cases is high, the torture to force the crime of dereliction, favoritism, capricious and arbitrary is increasing and so on. The main reasons of Job-related crimes in the judicial realm in Chuzhou are as follows:too much judicial power; the lack of supervision and restraint to the power and the aspects of judicial operations, incorrect of law enforcement, justice sectors still lack of running tight supervision, judicial officers vulnerable to profit-driven, the lack of punishment to Job-related crimes in the justice system, insignificant effect of the investigation and deterrent by prosecution, the low level of quality of judicial officers, with the mind of privilege and so on. This paper proposes countermeasures of consummate Job-related crimes in the judicial realm in Chuzhou, such as the improvement of legislation to restrict the discretion to promote professional development, strict legislation in practice, the establishment of limited staff and supervised mechanism to prosecution dealing with cases handled itself, reducing sentencing judge discretion, actively and steadily pushing forward judicial reform, strengthening supervision and the reform, regulating law enforcement conduct, refining standard of sentencing of uniform identification, perfecting attorney attending the Judicial Committee institute, strengthening the supervision to the cases of probation of judicial activities, applying anti-corruption investigation tactics, increasing efforts to combat crimes committed by judicial officers, updating law enforcement philosophy to promote self-discipline of judicial officers inside. Finally, this paper sums up the major work of the full text, points out the shortcomings, and proposes the further research.
