Aids Crime And Preventive Policies Research

The crime committed by the human infected with Aids has been already highlighted in our criminal theory research, of which the diversity and harmfulness to society leads to this crime complexity, and which reflects the criminal legislation loophole. This thesis just focuses on the discussion to reduce conditions of crime by human with Aids. Thus the legislative proposals on this kind of crime are raised.Foreign research about the Aids crime has come to a stage of ripeness. Many foreign countries have clear specific provisions related to Aids crime. While the systemic and mature theory about Aids crime has not come into being in our country, where many related districts provisions just act out the role of criminal law. Therefore, the study about Aids crime as well as its preventive policies is full of important theoretical and practical meaning. It is benefit to legislation and theoretical research in theory; it is also useful to punish Aids crime in practice according to the written provisions, indicating the important meaning in guiding the judicial practice.For the reasons above, I make study from the concept, features, current states, constitutive requirements, cause and the preventive policies of Aids crime, referring to the theories of crime along with penalty. On the base of abstract cases, I analyze fully all the possible conditions where Aids crime may occur, expecting to be useful to the criminal theory and judicial practice in our country.The thesis consists of four parts except the preface and conclusion. Part one, summarize of Aids crime. First, from the background where aids crime take place, referring to criminal theory, I put forward my own pinion about the concept of aids crime. Second, after presenting my concept of aids crime, I point out that aids crime has its own characters in addition to the common crime features. Third, according to many cases of aids crime collected as well as foreign judicial practice, the categories of aids crime are summarized. Every kind of aids crime is discussed in length from its concept, feature, means of behavior and current state.Part two, constitutive requirements of the Aids crime, in which the constitutive requirements are deeply analyzed of which the constitutive requirements are object of crime, objective aspects of crime, subject of crime and subjective aspects. Part three, contributing factors of aids crime, which is discussed from the subject aspect and object aspect of crime. For the former, the causes should come from the human himself or herself with aids committing crime; for the latter, the factors of law system as well as society and so on are included.Part four, preventive policies of aids crime, in which problems of Aids crime will be solved, some feasible proposals have been put forward to the constitution of law system, setup of crime title together with the value of punishment so as to prevent or reduce the harmfulness of Aids crime to our society.
