AIDS,which flows in the global, has become a major problem since the eighties of last century. But most of the public understanding of the disorder degree is still very low, When asked about or talk about, people’s first impression is that it is very terrible, avoid. Recently, the ministry of health of China and the United Nations programme on HIV/AIDS (unaids) published its first global report on the status of the HIV/AIDS discrimination. In this report is made clear that on HIV/AIDS patients to provide medical care, education service jobs, there are a lot of proportion of the staff of discrimination against AIDS patients showed very obvious.However, HIV/AIDS patients are infringed no matter in life, study or work, which seriously affect the life of AIDS patients and their families. Between curb the spread of HIV/AIDS effectively and protect equality rights, which have a close relationship, it has been widely accepted by the international society. Equality is necessary to guarantee civil rights in the constitution of our country, is the foundation of the citizens to enjoy the other rights.The author think that the lack of HIV/AIDS patients’ rights protection is the insufficient guarantee of equal rights in root. Safeguard the equal rights of HIV/AIDS patients are human rights and protect the rights of citizens’ basic needs, is the inevitable requirement of building a harmonious society. On how to perfect our country AIDS patients equal rights guarantee, should set up the right to life, the idea of the concept, justice and public responsibilities, learning outside the good practice, puts forward the opinions. As a Chinese citizen, HIV/AIDS patients should have the same rights with other citizens in the constitution and the law, at the same time, they should bear the corresponding obligations. HIV/AIDS patients should be provided a living environment more conducive to their physical and mental health, not be excluded from the social, which can make them to live a normal life like ordinary people.
