The Problems And Improvement Of Operation Mode Of People's Tribunals

People's tribunals are detached institutions established by the basic-level people's courts on the principle of"convenience for both the people and the courts". In years, people's tribunals have been playing an important role in economic development, legal system construction and the maintenance of social stability. However, the operation mode of the people's tribunals becomes more and more inflexible compared to the growing social demands of justice while the social conflicts become more complex and comprehensive. Such deficiency seriously impairs the function of the people's tribunals.In order to make the system of people's tribunal to play a better role in disputes resolution and building a harmonious society, this essay discusses the system of people's tribunal in three parts. The first part summarizes the concept and characteristics of the people's courts system, and analyzes the social background that leads to the unique operation mode of people's tribunals. The second part analyzes the problems of the present people's courts system history and the causation of such problems. The last part discusses deficiency of the present people's courts system and gives suggestions on the improvements in the operation mode of the people's tribunals, including renovation in justice philosophy, system reconstruction and reformation of justice operation.
