The Research Of The Issue Of International Humanitarianism Law In The Peace-Keeping Operation Of UN

According to actuality of peace-keeping operation of UN, whether and how the peace-keeping operation of UN applied the international humanitarian law was discussed first in this paper. Afterward using plenty of cases of peace-keeping operation and the practice of the author taking part in the first peace-keeping medical operation for Congo of China, the issue of peace-keeping operation applying the international humanitarian law was studied.The matters of the civilian protection,wounded and sick people protection,force using was researched in emphases, and giving the complementary advice, affording gist of law to the next peace-keeping operation.This study was divided to four chapters. The first chapter:the base of peace-keeping operation of UN applying international humanitarian law. Introducing peace-keeping operation of UN,the system of international humanitarian law,homological gist of peace-keeping operation of UN applying international humanitarian law. Commonly law principle of international humanitarian law,the debating of peace-keeping operation applying international humanitarian law was emphasized in this chapter.The second chapter:the issue of the civilian protection in the peace-keeping operation of UN. Its homological gist in peace-keeping operation of UN was expatiated; the actuality of civilian protection in peace-keeping operation was introduced. The conflict between civilian protection and peace-keeping operation was studied, and some complementary advice was given.The third chapter:the issue of wounded & sick person protection in the peace-keeping operation of UN. Its homological gist was analyzed in war time, and the actuality of civilian protection in peace-keeping operation was introduced. According to the practice of the author taking part in the first peace-keeping medical operation for Congo of China, the issue of wounded & sick people protection and conflict between medical conventionality and international humanitarian law were studied; some complementary advice was given according to actuality.The fourth chapter:the issue of force using in the peace-keeping operation of UN. The actuality of force using in the peace-keeping operation of UN was introduced from the homological gist. The conflict of task fulfillment and applying international humanitarian law was studied, and some complementary advice was given in the last.
