Researching On Application Of Community Correction

With the development of society, the mitigation of punishment has developed vigorously. Especially since the 1960s, imprisonment has been replaced by fine punishment, community correction and more humane ways. At present, the western developed countries have entered the time period that using punishment without imprisonment. Community correction, also called community in society punishment, inside society and outside institution punishment, is a new punishment way compared with the traditional imprisonment. Certain systems in Community correction such as probation and parole have more than 100 years history in the west. But the idea of community correction came into system after world war ii and developed in the 1960s, which turning into indispensable corrective measures and received wide application in the world.On July 10, 2003, in order to implement the criminal policy of tempering justice with mercy in China, the supreme people's court, the supreme people's procuratorate, ministry of public security, the ministry of justice in four departments issued . On September 2, 2009, in order to promote further development of community correction, the four departments published . Admittedly, our community correction was on the initial stage of exploration. Although there is some experiences and achievements, improvement is still needed for the theory and practice. Meanwhile, the community correction as punishment system reform in China is an important measure to promote and develop the criminal policy of China and will make long-term and far-reaching influence. In this context, it is greatly in need to strengthen the theory of community correction and continue practice. This paper aims at the low rate of community correction so far by using comparative, dialectical, synthetic method of combining theory with practice, studying the application of community correction in China and other countries as reference in order to make suggestion for community correction in China. The exploration may help to find out the way of community correction system in China to promote a better and faster development.This paper mainly talks about the three parts. The first part deals with the correction model in three main types of community correction to find out the differences and similarities. The second section introduces the present situation of community correction in China and analyses the reasons of lower rates of this application and its necessity. The third part makes the suggestion about the future adjustment of the community correction, aiming to increase the application of community correction by improving and adding systems.
