On Community Correction In China

Community Correction is a sort of penal method that manages and educates criminals with community resources, which can rehabilitate criminals without social isolation. Instead of imprisonment, community correction becomes a non-custodial penalty that reflects the tendency of global penalty ways changing from severity to relaxation. Originated in western countries like Britain and the United States, community correction has grown into a more mature and developed system. At present, community correction has already been on the pilot practice, and is still new in China. It is foreseen that the construction and implementation of community correction are of great significance for the promotion of the reform on the penalty system. As being at the very outset, undoubtedly, there are some problems existing in the development of community correction in China, which can not be neglected and are to be further studied, consistently corrected and hopefully perfected. The thesis is composed of four parts.Part I : Introduction of community correction. This part first attempts to improve the definition of community correction, and then makes clear the nature of community correction by analysis. Lastly, it introduces the theoretical foundation and presents the value of community correction system.Part II: History and practical experience of community correction. This part describes and analyses the historical phases of the development of community correction by comparison and summarizing of some successful methods and experiences of other countries.Part HI: Practice and puzzles of community correction. Focusing on the development of community correction in China, this part points out its inevitability and urgency of reality. On one hand the part affirms the positive effect which the practice and the spread of community correction achieves, on another hand it indicates the direction of our reformation and perfection through analysis and recovering of the problems and defects of the pilot practice.Part IV: The outlook for our community correction. Founded on the above parts, the author expatiates on the improvement and perfection of community correction with Chinese characteristics, which contains legal protection, foundation of organization and staff, punishment mechanism, measures of broader applicable range and effective method of correction.
