Research On The Rights Security Of Landless Peasants

Effective solutions to protect the rights of landless peasants, is not only the needs of promoting the industrialization and healthy development of urbanization, but also an important issue which building a new socialist countryside and a socialist harmonious society must face.This article, based on the academic research achievement, employing the research methods of the combination of theory and practice and the comparison of the reality and the history, carried out a systematic study and analysis of the current security situations of landless peasants nowadays. Generally speaking, the security problems of landless peasants have caused the attention of our government at all levels, but there are some problems and shortcomings in land system, land expropriation, social security, which specific measures are necessarily to taken to perfect and improve. In this paper, three-part analysis are proposed to analyze and approve these issues and the author's views are put forward.The first part is the overview of the rights security of landless peasants, interrelated theories of the rights guarantee of landless peasants and the necessity and urgency of the protection of their rights and interests.The second part analyzes the loss-land situations of the landless peasants and the basic situation of their rights security, reflectes in the shortcomings of measures, which protect the rights of landless peasants and tries to dig deep reasons causing the damages of the interests of landless peasants. On the theoretical and practical levels, solutions are proposed on the reform of rural land property rights system, the perfection of land requisition system and the completion of social security system in order to solve, smoothly, the right security issue of landless farmers and ensure the harmonious development between modernization construction and land use transfer.The third part are the refletions and countermeasures to protect the rights of landless peasants. Beginning with reforming the land system and improving the land requisition system, rights on land requisition are strictly limited to the market price, a fair and reasonable compensation mechanism is built to continuously improve the processes of land requisition and democratic supervision of land compensation funds. Starting from a sound social security system of landless peasants, according to the situations of economic development in different regions, for the landless peasants can be gradually integrated into the urban.This paper is that two basic areas are proposed which are compensation and security to protect the interests of landless peasants based on the realities of the loss rights of landless peasants. The core of the damages of landless peasants'interests is that the current land compensation did not reflect the principle of equal exchange market to give farmers reasonable compensation. It's a systematical defect of the loss interets of landless peasants to has a relatively hysteretic construction of social security system for landless peasants. Therefore, compensation and security are needed to reform to correct the system deviation and make up the system blank.
