The power of administrative organs should be restricted from two indispensably internal and external sides; therefore, as one of the democratic and legal support, administrative homemade has gained more and more scholars'support and recognition. Administrative homemade is not self-limiting of administrative organs on subjective sense. It's more about constructing a system for the administrative behavior of administrative organ, and ensuring the administrative organ to implement the system legally and rationally, while perfection of legislation escorts on executing the system. As an approach of governmental self-discipline, self-improvement pursuit of good governance, performance evaluation has been put into practice successfully in many countries, and institutionalize and systematism of governmental performance evaluation has become a trend for developing the system of performance evaluation. At present, many domestic legal scholars, from legal perspective, described relatively mature performance evaluation legislation in detail, and made beneficial exploration on relevant legislation of our country. Main papers include,《American< government performance evaluation of the review>》by LinHongChao,《Japanese government policy of establishing evaluation and policy implications of evaluation system Japanese< policy-and post-mortem>》by DongYouBin,《the evaluation method of the performance evaluation of the Chinese government legislation》by ZhangHong, etc.Government performance evaluation system has existed for a long time in the United States.《Government performance and results act》issued in 1993 was the first comprehensively standard law in the world for government performance evaluation, which has become the representative legislation in the field of governmental performance evaluation and a key to success for the reform of Clinton administration. The characteristics of GPRA can be summarized as universal application, specific organizational construction, flexible operation, result orientation of evaluation, long combines with short strategic planning and progressive bill application. Strategic planning, annual performance plans and annual performance report must be submitted within the prescribed time, by the prescribed procedures to the congress. Timely guidance and improvements can be given to government performance before the congress learns about the work of government. Thus, the United States government performance reform has been pushed rapidly.Japan possesses similar characteristics with the US while also develops their own as well. First, the objects of governmental performance evaluation have certain scope, mainly particular fields of government departments in research and development, public enterprise and governmental development aid. Secondly, more attention is paid to experts and scholars in the governmental performance evaluation processes. Also, public transparency is taken seriously during the appraisal process. Finally, different evaluation methods are selected in policy evaluation way instead of generalizing according to the evaluation items.At present, domestic legislation of government performance evaluation is relatively blank. Some government departments and folk organizations have practiced legislation of different levels, which laid a good foundation for legislation. So our country can take completely mature legal system for reference, formulate perfect law to promote government administrative ability, achieve the construction of service-type government.
