Research Of Controlling Public Servants Produced Commercial Bribery Problem In Administrative Ethics Perspective

In recent years, commercial bribery has become widespread concerned hot issues within the worldwide, the biggest economic losses, the largest social pollution and important political challenges. This phenomenon is particularly serious in China's socialist economy in transition. As Samuel Huntington said:"A country's corruption phenomenon is more common in the period of reform than other periods". Generally, it seems that corruption levels are related to the rapid modernization of society and economy."Today, commercial bribery has become"the market economy monster", seriously disrupted the market order, eroded public power and became the hotbed of public service corruption. Therefore, the resistance to commercial bribery has become a global issue, scholars from various countries have conducted more deeply analyzed on this issue, and many countries also have taken much worth learning from practice on controlling commercial bribery.Under the scientific hypothesis of the principal - agent theory and comparative advantage theory of people's assumptions of human nature, based on a new perspective of administrative ethics, with the ethical choice of public servants to exercise public power as the logical starting point, this paper will focus on the cost - benefit analysis and ethical choose analysis of public officials, then analysis the underlying causes of multiple commercial bribery. It tries to find the long-term mechanism covering institutional ethics and personal ethics to strengthen the ethical construction of curb commercial bribery to supervise public servants. These will suppress public service corrupted motivation and psychological from the original driving force, and combat the bribery in business from the ideological roots. The thesis consists of six parts:The first part is Preface. This part is briefly descript the main research background, research situation at home and abroad, research content, related concepts and research methods and innovation.The second part is the commercial bribery problem in the perspective of administrative ethics. These sections reveal its essence by defining the commercial bribery, and then analyze the basic characteristics and harmful of commercial bribery.Part III and Part IV introduced separately the theoretical basis and practical conditions to prevent civil servants to involve in commercial bribery. Those proved that the possibility and reality that public officials participated the commercial bribery from the theory and reality by analyzing the basic human nature, the analytical background, Root formation and conditions for implementation.Parts V introduce the motivation and reason that public officials involve in the commercial bribery. This part analyzes the reason of participating commercial bribery for public officials by using benefit analysis method from both internal and external causes, so as to provide a strong basis for later explore measures of combating commercial bribery.Part VI main explored these measures settling the problem of engaging in the commercial bribery of public service. Based on the analysis of the previous article, this part discussed the effective ways preventing public service participate the commercial bribery in administrative ethics perspective.
