Study Of The Legal Protection Of Inland Waterways In China

Inland waterways is a national strategic resource, which plays an important role in giving full play the advantages of sea transport. As the development of transport, the emergence of new circumstances, new problems in inland waterway protection have led to the lag of legal protection. This thesis aims to analyze the legal relationship in the management of inland waterways by ways of researching inland waterways authorities,waterway maintenance, legal responsibilities in inland waterways of legal norms. Through the analysis on the EU and its member states Germany, the Netherlands and the United States in the management of legal protection, this thesis will first point out that the imperfections of Chinese legal protection in management of inland waterways and what beneficial practices can be drawn from that of Europe and America, and then propose some suggestions to enact and standardize the law of the inland waterway policy. This thesis comprises the following four parts:The first part mainly gives a general introduction about the legal protection of inland waterways, defines the meaning and characteristics of inland waterways, compares inland waterways with coastal waterways, and expounds the principles and the main content of the legal protection of inland waterways.The second part mainly analyses on the legislative protection of inland waterways and the problems appearing in the legal protection of inland waterways. Through the analysis of the situation of inland waterway protection legislation, this part will propose domestic problems of river channel protection from the aspects:the waterway authority, inland waterway in the planning, construction, maintenance and liability, and so forth.The third part analyses the legislative protection of inland waterways abroad. It will demonstrate the feasibility for inland waterways of Europe's legal norms, and generalize the competent authority, the model of development and management, and make out the characteristics of the EU protection of inland waterways.The fourth part proposes the suggestions about legal protection of of inland waterways, and demonstrates the necessity to strengthen the protection of inland waterways. Basing on the analysis of the previous texts, this part puts forward a sound legal protection of the recommendations on inland waterways by ways of researching the statutory the funding from conservation channel, scientific channel planning and construction, construction and other branches of law the liability of convergence,and so forth.
