Shipping channel, as the foundation of water transportation, is not only the life line of the coastal ports, but also the non-renewable infrastructure. Being China’s main navigable rivers and the key element of the transportation system along the Yangtze River basin, The Yangtze River has played a crucial role in economic and social development of the Yangtze River region. As the throat of the Yangtze River waterway, obviously, the Yangtze estuary waterway is of strategic importance, as it concerns the economic and social development of the overall Yangtze River basin. In 2005, the Yangtze estuary waterway administration bureau was founded. As an institution directly under the ministry of communications, it carries out the planning, management, construction, and maintenance work of the 122- kilometer-long waterway from the intersection of Yangtze River and Liuhe River to the Yangtze river estuary, and it’s also responsible for the resources protection on the 12.5–meter–deep water channel and the natural deep-water channel in the Yangtze river estuary.Easily influenced by natural and human factors, river regime of The Yangtze River estuary is very complicated and changes frequently and its shoals are also unpredictably changeable. Behaviors like Illegal sand mining, illegal dumping, and illegal construction of water-related projects not only destroy the channel resources, change the terrain and river regime, but it can lead to potential navigation safety hazard. Authorized by the superior transportation department, the Yangtze estuary waterway administration institutions will enforce the law on the destruction of the channel and channel resources.On March 1, 2015, the Waterway Law of the People’s Republic of China was enacted. It opened up a new situation of waterway administration in our country. Since the establishment of the Yangtze estuary waterway administration bureau, taking the problems encountered while pursuing the legal responsibilities of the illegal behaviors as the breakthrough points, the author sorted the various illegal acts in the Yangtze River estuary, and analyzed the legal responsibilities these offenders should bear. Aiming at the existing problems involving the impossible law accountability for some unlawful acts, and the obstructions against the implementation of the channel administration and the effective protection of the Yangtze estuary channel and channel resources, the author conducted detailed analysis, and put forward some countermeasures to solve the problem of impossible law accountability and lay the foundation for the smooth implementation of administrative law-enforcing work by the Yangtze estuary waterway administration institutions.Based on the analysis of the illegal behaviors and the legal responsibilities, this paper sorted the illegal behaviors and the corresponding legal responsibilities discovered in the administrative law-enforcing work and analyzed the existing difficulties in the process of pursuing legal responsibility of the illegal acts in the Yangtze River estuary as well as their causes. To improve the administrative law enforcement and its effects, promote the construction of law-enforcement department and ensure effective protection of the Yangtze estuary channel and channel resources, Combined with the practical work, the author has put forward solutions to these problems.
