Research On Online Pornography Crime Investigation And Prevention

Pornography and goods is always the target forbidden and combated by provisions, the threat of them to national security and social order is not broadly apparent, but they have subtle harm on people's physical condition and social stability. With the development of modern science technology and the increasing popularity of internet, online pornography spread unchecked which encouraged by online pornography interest chains, network became the main platform of pornography industry. Online pornography has been"a tiger on way"that obstruct the healthy development of internet culture, not only anti-porn working is embodied in curriculum content of the department concerned, but also pornography, as to gambling and drug, is the target combated and resisted by social opinion and ideological form. The harmful effects of online pornography received much attention of relevant departments in many governments; it has become a common behavior by most countries in the world to take action against online pornography crimes for purring the environment of internet. Based on the exposition of conception and basic characteristics of online pornography crimes, this essay summarizes the conditions how national and international governments to combat online pornography crimes, then analyzes the cause of repeated. Online pornography crime is different from other online crimes, so extraordinary means, such as secret investigation, should be used in investigation process to detect such crimes and conviction standards must be uniformed. In order to combat such crime better, we must strengthen the construction of network information resource database and introduction of professionals. Of course, online pornography crime is a social ill; we can not eradicate it with temporary actions, or seeking out ways to prevent from it behind closed doors. By studying the methods taken by the United States, Britain, Germany, Japan,Korea and other countries, this essay analyzes the measures to be taken by our country, that is improving legislation, standardizing investigation measures, specifying legal status of electronic evidence, increasing relevant charges, such as the crime making,duplicating,selling and transmitting child pornography with network, and issuing the Mobile Phone Charges Normative Law, cutting online pornography interest chains, establishing Internet Content Hierarchical System, distinguishing adult websites and common information websites, enhancing cooperation with foreign countries, for combating the crimes with international forces. The innovation of this paper is: 1) the classifications of online pornography crime. It has three basic forms based on the form that subject of crime contain crimes, and it has two whether for personal gains; 2) the legislature should issue the Mobile Phone Charges Normative Law, the telecommunications departments must offer the service of mobile phone charges for the mobile number registered in true name only; 3) increase the search engine service provider as the subject of online pornography crimes for regulating their behaviors by legislation.
