| Regarding the definition on online rumor mainly dividing into two views,namely view in broad sense and view in narrow sense.This paper adopts the view in narrow sense,namely online rumor is the views information deliberately fabricated by citizens going against the objective fact and broadly communicating among audiences.In terms of the various kinds of online rumor events,online rumor has risks of disturbing personal life order,disturbing market economic order,lowering down government credibility and lowering down online credibility,therefore the online rumor needs to be cracked down and regulated.But online rumor has characteristics such as large quantity,multiple categories and rapid communication,so it is very hard to regulate it.Online rumor has become one tricky issue in the modern society.Among the complicated online rumors,online rumor regarding food has a higher proportion and big influence on our daily life.Therefore,taking the big online rumor events regarding food in recent years as cases,this paper finds out that issues exist in regulating online rumors by administrative laws in our country so as to provide some solutions.First of all,this paper makes a list on the ten online rumors regarding food in recent years in China as samples and makes its brief introduction;secondly,this paper analyzes the current status of the online rumor's administrative law in our country from three aspects,including regulator,regulating mechanism and regulating means.The research holds the view that the administrative law in China regulating online rumor has issues such as improper regulation,untimely regulation and insignificant regulating effect.The reasons for these issues include the lacking of relevant legal system,unfulfillment of government information publication,weak punishment on law breaker,low netizen cultural literacy,responsibility awareness and singleness of regulator.At last,based upon our country's national conditions and world's regulation experience,this paper proposes own suggestions for administrative law to regulate online rumor in our country:1.Make special administrative law to regulate online rumor;2.Perfect government information publication mechanism;3.Perfect administrative accountability mechanism;4.Build online rumor pluralism regulating mechanism dominated by government;5.Improve netizens' cultural literacy and responsibility awareness.In the background of rampant online rumors day by day,how to regulate online rumorwill grow into a permanent topic for us to discuss. |
