ABSTRACT:Administrative organs at all levels of our country are the main bodies to run the power. The power of the administrative organs at all levels comes from the people, and ultimately must return to the people. The people have the rights to supervise the contents, procedures and processes of the government. "Open Government Information" (following referred to as the "Regulations") makes that to open the information obligations. Frankly disclosure the information for the public makes more trust on the government, but also urge the Government to nose to the grindstone. This article based on "exceptions", intended to "open." Only a clear and narrow exception to the scope of information can identify and expand the scope of public information.This article based on the basic theory of exceptions of opening government's information, and analyzed the exception of the government information legislation of American and Australia, then draw on the Enlightenment. In this thesis, more profound discussions of current situation have been made for the exception of the government information legislation. And a number of shortcomings have been summed up, just as the legislative ideas, legal forms, legal relations subject, scope to open and administrative remedies. Finally, propose a system of suggestion to open government information, that start from the legislative concept and the legislation principle, correct the distinction between the main body to open the government information, clear the criteria for judging the government information, to establish a relatively independent body to review the information.
