Legal Issues Of Confidential Government Information

The information resources is one of most important strategic resources to a nation. It is necessary to pass the information law to determine the boundary of the public and secret information. Under the background of making government information to the public nowadays, some conflicts between keeping secret and public appear, and the secret law has disjointed with its fulfillment in China. Both of them should to be adjusted soon. To solve the exsisting problems in the system of government's secret and public information, this text focuses on the principle and relevant provision which should to be improved. Although because of lower ability, some mistakes will be unavoidable in this text, I 1 want to make some contributions to the cause of contruction of secret information in our courtry.Taking into account the important significance to conservative state secrets for the current confidentiality laws, this paper focused on the Influence and hinder that the laws will affect the open of government information.Combining the development trend of information which is used to conservative and open , this paper clarifies the significance and necessity to improve the government's information security law. This paper presents the overall positioning of confidentiality laws and the guiding ideology and principles that improve the government's information security legislation should adhere to. From the perspective of the government identified the scope of secret information and the right to Mi set and decrypt, the article further proposed the current government information confidential legal flaws and improvement.This study uses the comparison of methods to investigate confidentiality model legislation in other countries and the aspects that are worth learning. The article uses an empirical study to investigate a number of issues, including confidentiality laws in the scope of the clandestine practice of overcharging and can be secreted by anybody and it was no secret decryption scheduled etc. The article concludes with the ideas and programs to perfect the confidential government information legislation.This paper is divided into four parts. The first part introduces the situation and background of the government's information security; The second part of the article is the legislative practice of confidential information; The third part is the concept of positioning and change for that ; The fourth part is the idea of amending the law of confidential information. This text consist of four parts, the first part make a clear boundary among the national secret and work secret ,the second part introduces how to design airtight power, the third part will give a detailed procedure of meticulous care, the last part provides some advices of improving system of secret reviewing, wade airtight litigation and punishment.Conclusion: the meaning of improving the government's Privacy legislation and legislative Direction.
