Research On The Issues Of Right Protecting Function Of Educational Trade Union In Primary And Secondary School In China

Educational trade union in primary and secondary schools is an important part of the trade unions, it plays an important role in school domestic management. But, the educational trade union did not function well for a long time. With the deepness of Chinese opening and innovation, engagement system and teacher performance pay system appear in sequence in educational field as the institution reformation goes. Now, the labor relations between teachers and schools with market and contract directed characteristics appears. Then there will more and more labor disputes and labor conflicts arise, and this calls educational trade union to role well what it should be. The Trade Union Law published in 2001 pointed that trade union should take protecting workers' legitimate rights and interests as its basic responsibility. Then under such background, it takes important theoretical and practical significance in research on right protecting function of educational trade union.The paper, according to the seven tasks of trade union, divides educational trade union's work scope into four aspects as following:adjusting school labor relation; protecting participate in school democratic management; living protecting; enhancing teachers' quality, Ten schools in three cities of Hebei province are studied. And the study is made throng questionnaires and talking syllabus to find issues of educational trade union. At last, the paper proposes the relating solving measures on results of the study.The paper gives countermeasures and proposals according to the current status of educational trade union. It mainly includes:the internal reform should focus on socializing the educational trade union to reform management model, regressing economy and personnel power to change dependently situation; the external construction reform should focus on improving the Trade Union Law put forward macro level protection, setting up supervision mechanism to put forward meso level protection, changing school management system to put forward micro level protection.
