Research On The Related Problems Of Law For Maritime Rescue Of Human Life

Maritime life rescue is the key line of defense for protecting the life security at sea. With the development of the times, the gradually raising of people's subject status and human rights awareness and the increasing highlights on importance of the maritime life rescue takes the life rescue legal system leading the much more crucial position in the framework of the marine rescue law. Therefore, the establishment and improvement of the life rescue legal system becomes a very research-valued and practically significant topic.Based on the above considerations, this paper, from the basic concept of the maritime life saving, attempts to think, to analyze and to discuss the legal issues relating to the maritime life rescue actions in our country and takes the suggestions on improving the maritime rescue reward mechanism combining with the current maritime life rescue system in China.The paper includes four parts. First of all, it states the concept and the related legislation of the maritime life saving. Meanwhile, combined with the concept and characteristics of maritime life saving, it analyzes the connections and differences between maritime life saving and property rescue, environmental protection and non-marine rescue, discusses the value targets of legislation on "people-oriented" in life saving at sea and points out the scope of applications for life saving in our country. Secondly, the paper, according the current maritime life rescue system in China, notes the authorities concerned of the maritime life, the main force for maritime rescue and our country's maritime rescue management. In third part, in combination of the maritime life rescue practices, with citing a large number of working cases, the four relevant problems are analyzed. The first is the rights of asking for the remuneration of maritime life rescue, the second is the legal regulations of rescue resource waste, the next is the exempting crime-committing duties of the rescuers on the process of emergency rescues and disaster relief work at sea and the last one is the relevant legal issues on the construction of maritime life saving volunteers'team. In following part, the suggestions on establishing and improving the maritime life rescue reward mechanism in our country are proposed, and the necessity and feasibility of establishing and improving the maritime life rescue reward mechanism are analyzed according to the experiences of foreign countries. For conclusion, some relevant legal suggestions on maritime life rescue are proposed, which in order to assist in encouraging the maritime life rescue and improving the maritime life rescue system in our country.
