Research On The Parole System In China At The View Angle Of Community Correction

In the background of the world trend of venial penalty and socialized execution which are irreversible, parole has become an important system of socialized execution, and be highly applied in the practice of punishment execution. In July2003, the criminals on parole were explicitly listed in the community correction experimental unit for the first time in China. Even after this, the correction was not appropriate and several kinds of problems still existed due to kinds of reasons. Therefore, reevaluating parole system of our country at the angle of community correction is very important both theoretically and practically so as to improve this system. The writer starts from the basic theory of parole and community correction to introduce the evolution and development status of parole system both at home and abroad, and also points out the problems of the parole community correction theories as well as practice through the comparison between the developed countries and China, so as to present some targeted assumption on reform and development of the parole system which are beneficial for improving the community correction system on parole criminals.The new points of view in this thesis are:1.At present, there is a great variety of works and research papers;their emphasis is on how to enhance the supervision and inspection to the parolees, but seldom research the improvement methods of parole system at the view angle of community correction. The latter one aims at not only the supervision and inspection, but also the correction, education and reform to parolees.2. This thesis specifically analyzes kinds of institutions and measures should be completed in the process of community correction, in particular discusses about and interprets kinds of measures on personality assessment, danger prediction system and community correction organization construction, reform and education as well as enhancing the procuratorial organ’s supervision and inspection in this process, and present preliminary ideas good for improving the community correction to the parolees.
