On The Legal System Of Corporate Social Responsibility Under The Economic Law

In the market economy, enterprises are in a dominant position. Its degree of social responsibility is directly related with the development of a market economy. In the highly developed market economy of modern society, the government how to play the role of law and encourage enterprises to fulfill their social responsibilities actively has become the focus of social concern.In this essay, author use the method of historical analysis and comparative analysis. First of all, from the basic theory of corporate social responsibility, I use the way of historical analyze the historical evolution of corporate social responsibility and the current specific problems, particularly in the milk Events, water pollution incident of Jilin, mine incidents of Shanxi. How to improve our corporate social responsibility has become an urgent problem. Then, through the method of comparative analysis, I analyze the legal of provisions of corporate social responsibility. Finally, I make recommendations of corporate social responsibility. This article is divided into four parts:From a theoretical point of view, the first part introduces the basic concepts of corporate social responsibility and significance, shows the market economy and the relationship between corporate social responsibility; Secondly, from the value of the three major economic law, I analyze the market economy and legal system of corporate social responsibility necessity. This paper argues that corporate social responsibility plays a good role in maintaining social justice, improving the social efficiency, promoting economic freedom and order.The second part describes the evolution of corporate social responsibility process, and notes the problems in the legal system by analyzing the status of corporate social responsibility. According to the legal situation of the different stages, the development of corporate social responsibility to the legal system can be divided into four different historical stages of development. In the implementation of corporate social responsibility, the 2005 "Company Law" is a milestone in the process of the rule of law in the market company. It represents the legal system of the development of social responsibility into a new stage. However, our corporate social responsibility is still a problem.The third part describes the common features of the legal system of the United States, Japan, Britain, Germanyon the characteristics of corporate social responsibility.Besides,Non-governmental organizations that focus on the role of corporate social responsibility. It combines the government, business, non-governmental organizations, and social media together. An d it can be able to avoid the split between the phenomenon of obstacle to enterprise development.On the theoretical basis of the corporate social responsibility, the fourth part analyses the existing problems that our country faces , I combine the foreign advanced system and the actual conditions of China together. After careful consideration, the author proposes corresponding measures in order to improve our system of corporate social responsibility.I try to create the legal system which conforms with this stage of development of market economy and corporate social responsibility, What's more, I expect to incorporate the corporate social responsibility into the process of the rule of law. It is useful for the market economy of China.
