On Construction Of Legal System Of China's Telecommunications Universal Service

Comparing the increasing development of telecommunications industry in our country, the legislation system of it seems to be incomplete dramatically. It could be known that other countries, which succeed in implementation of telecommunications universal service, are mostly supported by complete telecommunications legal system. For a long time, the telecommunications universal service is impeditively developed by the long-term vacancy of"telecommunication law"and the present imperfect"telecommunication rules". As the coming launch of"telecommunications law", this article is focused on the issues of how to complete the legislation of telecommunications universal service. The main contents of this dissertation are as follows:The first part introduces theoretical issues of telecommunications universal service. Based on the research of universal telecommunications service's history, the definition is made clearly at first, and then the theoretical basis is explained in terms of sociology, economics and law which is the foundation of the further statement.The second part indicates the development of telecommunications universal service and analysing problems of it. According to the mainline of telecommunications universal service development, which is divided into the period of before and after its reform, the related legislation development is introduced and the problems are definitely analyzed. Further the problems rised as the construction of telecommunications universal service legislation are analyzed: Firstly, the universal service legislation needs to consider the balance of interests in the telecommunications market, including the regulation and competition, as well as the consumers and the operators. Secondly, telecommunications universal service should advances in technology, market competition and changes in the pattern of coordination problems. This is one of the innovations of this paper.The third part analyzes the global legislation of telecommunications universal service. By the empirical and inductive analysis, the foreign telecommunications universal service legislation is investigated and compared with our country's, More importantly, the experience could be learned.The fourth part provides suggestions on how to complete our country's telecommunications universal service legislation. In this part, the legislation objective is located exactly, which is the basis of proposals how to complete the telecommunications universal service legislation. Furthermore, it recommends the construction of telecommunications universal service legal system with multi-level and explains the specific rules. As the result of the project, principle and contents of the telecommunications universal service are established in the legislative view, also the implemented mechinism of telecommunications universal service is constructed in light of competition, which contains the implementation subject, financing techinques and compensation mechnism. After that, the management mechnism is advised to be reinforced and completed.
