Research On The Legislation Of China's Telecom Universal Service

With the deepening of telecommunication reform in China, the limitation of the implementation of universal service by administrative means has become more and more clear. Universal service is facing increasingly serious uneven development among regions, a shortage of funds and other issues. In addition, for the deficiencies of the existing laws and regulations on universal service, the implementation of universal service has not received effective legal support.This dissertation will analysis and discuss some issues of China's telecom universal service legislation. First it elaborates the legal nature of telecommunications universal service and its principle from a legal point of view. Then, it introduces the course of the implementation of telecommunications universal service in China and its features. After all these introductions, the dissertation analyzes the defects of existing laws and regulations on universal service and the necessity of improvement of the legislation on universal service.The emphasis of the dissertation is to research how to improve universal service legislation. In determining which telecom carrier should bear universal service obligation, the paper holds the views that all of the telecom operators should bear universal service obligations. With regard to the process and means of choosing universal service provider, tender is the best option, but the reality of China's national conditions still needs the designating, so this law can be made flexible, clearly stipulating that the conditions applied in two ways.
