On Mechanism Perfection Of The Citizen Participation Of Local Legislation

With the development of society,"A Open Legislation"which allows wide participation of the public in lawmaking has become an irreversible historical trend of democracy improvement and legal system establishment. Local legislation in China complies with trend of social development and also carries out diverse practices of developing the mechanism of citizen participation. In view of the above opportunity, four aspects of the mentioned topic is discussed on how to consummate the mechanism of citizen participation in local legislation.In the first part, the general theories of the mechanism of citizen participation in local legislation are stated. Conceptions in local legislation are defined and put into juridical analysis, which specifying the core intentions of this discussion, the characteristics of local legislation and the corresponding positive functions is also analyzed on the basis of theoretical definition.The second part reveals various problems which citizen participation faces in local legislation and undertakes an analysis on underlying reasons in accordance with superficial characteristics of these problems. Therefore, the status quo of citizen participation in local legislation of China is more clearly explained. Besides, it lays a stable foundation for the fourth parts.Living examples of citizen participation in local legislation of foreign countries such as U.S.A, Britain and Japan are cited and analyzed in the third part of the paper in order to see what we can use for reference. Moreover, it provides a support for the following discussion on mechanism perfection of citizen participation in local legislation. The fourth part is the key chapter which contains a detailed discussion in allusion to the aforementioned imperfections. Taking system as entry point, the author intends to build a respective comprehensive system of citizen participation by improving four major regulations including perfection of citizen participation rules, perfection of legislative information disclosure, promotion of enthusiasm in citizen participation and establishment of legislative staffs in communities, and consequently expects that citizen participation can be put into practice smoothly in local legislation.
