Study On The Perfection Of Public Participation In Local Legislation

Rule of law is the basic way of governing the country,and good law is the premise of good governance.Good law should be the concentrated expression of the common will and public interest of the public.Public participation is an important part of the legislative system of modern country under the rule of law.It is an important support for the scientific and democratic decision-making of the legislature.It has an important position and function in the process of legislative decision and activity.It is also an important measure to promote the goal of the rule of law in our country.The nineteen major reports of the party clearly pointed out: Deepening the practice of ruling the country according to law,promoting development by good law and ensuring good governance.We should further innovate the way of public participation in legislation and widely listen to the opinions of the masses.This puts forward new and higher requirements for local legislation in the new era.In the five years since the eighteen years,the construction of the rule of law in China has made great progress,the strategy of governing the country by law has been fully promoted,the rule of law system of socialism with Chinese characteristics is becoming more and more perfect,and the concept of the rule of law of the public is obviously enhanced.Participation in legislation is an important political right enjoyed by the public,as well as a requirement of democratic legislative principles.Local legislation is closely related to the production and life of the local people.Compared with national legislation,the public pays more attention to local legislation.And with the rapid development of the economy,the awareness level of public participation in political activities is also increasing.Finally,the desire for participation in local legislation is becoming more and more intense because of the closer ties between the citizens' own interests and local legislation,and the public participation in the process of local legislation has become the future.The established facts that can not be avoided in the process of local legislation.On this basis,from the theory of the people's sovereignty and the theory of consultative democracy as the breakthrough point,through the empirical study of the development of local legislation in Anhui Province,the author chooses three representative cities as samples to further analyze the existing problems in the system of public participation in local legislation in our province.It is found that the public participation in the local legislation in Anhui is inadequate,the scope and means of public participation are limited,the public participation is lacking in more detailed procedural safeguards and the lack of public supervision in the legislative process.Therefore,it is necessary to put forward suggestions for improving the practical difficulties faced by public participation in local legislation practice.First of all,local legislation needs to expand the scope of legislative information open,broaden the public channels of legislative information,and ensure the public's right to know.Secondly,it is necessary to expand the scope of the public participation in legislation,expand public participation in legislation,constantly improve public opinion expression channels,and protect the public's participation rights;again,it needs to be clear To establish the feedback of the results of the legal hearing and the selection mechanism of the participants,to clearly distinguish the nature and procedures of the local legislative Symposium and the hearing,and to make clear from the two aspects of the material and spiritual rewards to stimulate the public participation in the legislative hearings,to ensure the orderly participation of the public and the legislation;finally,to make clear the public participation.The legislative supervision of the right to promote the supervision by the public power,the public has the right to supervise the process of local legislative activities,the right to participate in the post legislative evaluation activities,the right to propose legislative review proposals,and to deepen the legislative supervision through the network media and the "big data" technology force to guarantee the public supervision.The fundamental system of our country is the socialist system,and the essence and core of socialist democratic politics is that the people are masters of the country.Carrying out and implementing the "mass line" in the process of legislative activities is an important manifestation of the people's right to be masters of the country and the idea of "legislation for the people" in practice.As an important key link,public participation is to ensure and effectively implement the rights of public participation in legislation through a scientific and rational institutional arrangement.
