Studies Of Problems And Solutions Of Citizen's Participation In The Legislation In Local People's Congress

In order to guide and promote the role of legislation,the Fourth Plenary Session of the Eighteenth Central Committee of the Communist Party of China put forward that the construction of the socialist system of rule of law and socialism with Chinese characteristics must be preceded.It's obvious that the focus of Chinese rule of law reform is in legislation,scientific legislation is the first step in comprehensively promoting the rule of law.With the deepening of legal reform,guiding the citizens' orderly participation in legislation is attaching more attention.In March 15 in 2015,the third meeting of the Twelfth National People's Congress adopted a modification about Legislation Law,and made some requests to expand citizens' orderly participation,while emphasizing the leading role of NPC in legislation.As for expanding the legislative orderly ways of public participation,which shown several times on the recent reports about the congress of party representatives attracted people's attention.On behalf of a new concept,it is necessary to conduct an in-depth discussion.In this paper,as a base on the theoretical and legal basis of the orderly participation in local people's congresses legislation by citizens,analyzing a few questions that may need to be addressed in the process of citizens' orderly joining in NPC's legislative activities.According to that,the core is the institutional building about the legislative participation by citizen should strengthen,including core and specific legislative supporting systems.Core system is to avoid the anomalies of the legislation or being dummied in execution,playing a guiding role of legislation to regulate.Meanwhile,a series of supporting systems related to the legislative process should also cooperate together.Based on the theoretical basis of the legislation of the local people's congresses of our country,this paper analyzes the necessity and the existence value of the citizens 'participation in the legislation of the People's Congress in an orderly manner,and analyzes the present situation of the citizens' participation in the local people's congress legislation.What's more,this paper sums up the problems existing in the process of legislation of the People 's Congress.Besides,the paper analyze the reasons and offer the solutions to improve the citizens' participation in local legislation.In the same time,broaden the channels of citizen's legislation participation,encourage citizens to using the public media,new media as well as social organizations to facilitate citizen's participation in the National People's Congress legislation is critical.That should shape standardized institutional arrangements.In addition,in order to make citizens' actively,orderly and effectively participate in legislation,improving citizens' cultural quality,political ability is important.So,it is necessary to nurture civic organizations to help citizens express their ideas and suggestions in legislative organization to improve the order and validity of the legislative participation.In summary,we need to innovate and explore both related theories and practice to develop and improve relevant laws to ensure democratic legislation.
