The Country's Subsistence Allowance System

As from the "Eleventh Five-Year Plan" into the "twelfth Five-Year" Plan, China has made great achievements which attracted a lot of attention from worldwide in socialist construction . However, in the "twelfth Five-Year", we have to clearly see the deep-seated problems have restricted ours developmentsin many field, and even some of the issues has become a bottleneck restricting the further development of our country, so the state strategic focus on these issues . Pay more attention to people's livelihood, pay more attention to the party and the state fair as the starting point, but how to fair, how to make the fruits of reform and development so that people across the country to share, this is how to distribut after the cake made bigger, that the distribution of wealth. I believe ,It is the key that how to distribut the equitable the wealth to the vulnerable groups of society to enjoy the wealth of their , because the rich people do not lack the ability of access to wealth . For this problem a lot of social scientists and economists have made a lot of research, but the problems are not yet soluted is the missing of legal system , especially in rural minimum living security system is missing. This is also the author of this topic as one of the reasons my dissertation topic. Also with the accelerating process of urbanization, land protection and family security become increasingly weakened, pro-poor policies and objects are constantly changing, the rural minimum living standard security has increasingly become the focus of the community. In the current urban minimum living security system is the evolving situation, how to solve a large proportion of the rural population accounting for the minimum living security issues become more urgent. From the mid-nineties of the twentieth century began to explore and study the establishment of rural social security system , local government is constantly trying to test minimum living new ways , but because of the special circumstances of our country, and many complex factors, the rural minimum living allowance system reform has been stalled. With the basis of China's basic national conditions ,and the premise of the reform, how to establish a set of local economic development level, multi-level, non-equilibrium of the rural minimum living security system is more practical . I take this as a starting point, try to do some theoretical research to the minimum living standard security system so that give the help to establish a comprehensive .In The first part,from the rural minimum living security system , we expand the nature and value of the minimum livelihood guarantee system for rural research, we get a legal point of view, this is to build our rural minimum living security system the most basic level, but also One of the most fundamental reason. Concluded that: the rural minimum living security law is the basic right of development right to life and the protection of law, the Basic Law, the weak protection of society, the laws of regulating the distribution of income, then the pursuit of distributive justice and achieving social equity is the value of the target.The second part is to analyze the current system of minimum living guarantee system and the relationship between poverty alleviation and minimum living guarantee system. Only the right to handle the relationship between these systems so that the two make a omplement each other, but also makes the system settings do not overlap. Obtained through analysis: the minimum living security system is to maintain the basic living of farmers, "fallback" system, while the system is to achieve poverty alleviation and development of farmers ,which they become rich development. A focus on the protection of basic living, a focus on capacity building for their own development, showing that the role of the two systems are different, are not substitutes for one another, or because the establishment of a system while ignoring the other system was established.The third part is an overview of the current minimum living security system in China . History is a mirror of reality, only by constantly review and look back at history ,we can continue to push forward the existing system more in-depth and detailed understanding. This paper reviews the one hand, since the founding of New China on rural widows and the needy and the disabled relief, on the other hand that China's rural minimum living security system at this stage the exist the problems, to look forward to the next part of the minimum living security system pave the way to do under construction.The fourth part is of perfecting our rural minimum living security system . This article is part of the focus and core. This section analyzes the security system of minimum living difficulties and the need , for example, the existing rural land protection and the minimum living security system interface, the rural minimum living security fund raising and so on. These problems will hinder the improvement and development of ours's rural minimum living system. Finally, the author recommended work out a "rural minimum living security law," which is fit for the development of an appropriate rural development,and the protection of objects of the rural minimum living security system , security standards, how to raise and manage the fund , government agencies and their staff's legal responsibility , the protection of the legal remedies have done a major deal .I hope the points can improve rural minimum living security system.
