The law-based administration embodies the transformation of the Chinese government from the management model of the plan-oriented system to the service model of the market economic system. This transformation is one from government of the master to the government of the servants. China's reform is a gradual one and its political reform is still lags behind the economic reform. Thus in this kind of situation, it is not easy for the government, especially the law-based administration to make progress. Since the implementing the reform and opening policy, especially the Program on Performing Official Duties in Accordance with the Law promulgated in the 15th NPC, the law-based administration has become the important concept of Chinese government for the people, as the important and key part of governing the country by law. Chinese government has promoted the great reform and has made great progress, for example, in the aspect of system, the actions was made to enforce the supervision to the market so as to meet the needs of the market economy to the law-based administration. In the aspect of administration by law, the transformation form the one by force to the one with service and the all-rounded supervisor system had been formed. As to the administrative relief, there are varieties of channels, such as, administrative re-discussion, administrative lawsuit, to protect the reasonable interests of the administrative objects. But it cannot be denied that there are many problems in the practice of the law-base administration because the current surroundings do not bring the positive influence to it. The improper or breaking-law administration still exists.There are six parts in this thesis including the introduction and the conclusion. The introduction starts with the improper and breaking-law behavior in the local government and its gaps with the requirements of the law-base administration. It shows that law-based administration is a complex and difficult task. The first chapter makes an explanation of the connotation of the law-base administration, as well as it background (historical, political, economical, and international background) and practical progress (its initiative, developmental and all-round advancing stage). It makes a general analysis and description to the actual situation of the law-base administration since the reform and opening-up. The second chapter analyzes the important role and the basic principle of the law-based administration in the local government. It not only makes its important strategic position clear, but also tries to make a general account of the principles of the law-based administration in the local government and makes an attempt to make up the shortcomings of the law-based administration.
