Study On Inspection And Quarantine System Construction & Countermeasures Dealing With TBT

With the development of economic globalization, technical barriers to trade (TBT) plays an important and reasonable role in the protection of national safety, human, animal and plant life or health, the environment and the prevention of deceptive practices as well, and is also gradually becoming an important means of trade protection. The inspection and quarantine affairs are closely related to TBT, as the state inspection and quarantine administrative organ is the main body of enacting, implementing and settling TBT. The system of inspection and quarantine is essential to the protection of national basic economic rights and safety and the guarantee of foreign trade development.Firstly, beginning with the basic concepts, forms and developing trends of TBT, the paper is devoted to establishing a political and economic model of the formation and operation of TBT. With this model, it discusses the correlation between TBT, inspection and quarantine and international trade, the operating system of TBT and the supporting function of inspection and quarantine technology to TBT. The paper considers that the formation of certain TBT is a correlated balance process of the government and the benefits groups in foreign trade affairs. The government provides policies on TBT through inspection and quarantine system arrangement, among which inspection and quarantine labs provide technological supports for these correlated partners. Secondly, with the theory of economics, the paper analyzes economic domino effect of TBT and its impact on the foreign trade of developing countries and China and its demand to inspection and quarantine department. At last, by analyzing and comparing the difference of inspection and quarantine system arrangement related to TBT in various countries and their enlightenment to China and by studying the practical cases, the author suggests that we should establish inspection and quarantine system through improving legal system of inspection and quarantine, establishing and improving inspection and quarantine measures and system and carrying out the institutional reform. We also should take five countermeasures to deal with TBT, that is, establishing prevention system, carrying out supervision model reform of inspection and quarantine, facilitating technology development and study, taking actively use of WTO dispute settlement system and facilitating information construction.
