Protection For World Cultural And Natural Heritage From The Vision Of International Law

The conception of the "World Heritage" was first established by UNESCO (United Nations Educational, Scientific and Cultural Organization) in the Convention Concerning the Protection of World Cultural and Natural Heritage (1972). There is epochal significance in the conservation of common cultural and natural heritage of human beings. Since the Convention was signed by many states, a series of new world heritage were declared. Protection of world cultural and natural heritage has been become a globality project, and theories of protect world heritage have been developed. But the world heritages are facing the un-evasive threat. The factors threatening heritages mostly are large-scale public or private projects, rapid urban or tourist development, accelerated deterioration and changes in the use of the land. In order to protect the cultural and natural heritage of outstanding universal value, international community try their best to establish an effective system, which organized on permanent basis and in accordance with modern scientific methods.China has abundant cultural and natural heritage resources, but these heritages are facing the un-evasive threat, too. The lacking of the legal protection is the main cause of the threatening of the world heritage in China. Thus, it become a significant task that establishing the legal system about protection of world heritage, according to the present situation about world heritage in China.Sum up, world cultural and natural heritage protect is a great infection issue which is involved a wide great scope. It cannot be solved by a kind of research or a subject. It is not only a theoretical issue but also a practical one. This thesis, usinghistorical analysis and comparative research, made quite a further research on the protection of world heritage from the following aspects:First of all, the thesis analyzes history and development of the world heritage, the threatening of the world heritage was summarized. It also analyzes the character of world heritage and discusses the significance of the world heritage protection.Secondly, The thesis analyzes the present situation about the protection of world heritage from the view of the legislating and the development of protection organization. It unscrambles the Convention Concerning the Protection of the World Cultural and Natural Heritage from the tenant and the contents.Thirdly, The thesis researches the responsibility of the concluding country. Meanwhile, the thesis put forward the behavior of destroying world heritage is an international environment crime and the country should be answer for it.Finally, the action of joining the convention and mostly achievement are summarized in the part. According to the actuality, this study put forward legislative suggestion that contains four aspects: matching with the basic principles of international treaty and agreement, organizing national heritage committee, making a difference between cultural heritage and natural heritage and giving difference protect measure, increasing national capital devotion. At last, the study gives a brief ideal about the law on protection of world heritage.
