On The System Of Land Expropriation

Land expropriation is a power act on the purpose of public welfare. The land, as elementary material, is it's object. Therefore, land expropriation is very valuable for the balance between public welfare and private welfare, and it also can promote the development of society in prefect harmony. Almost all the western countries had made more integrated system of land expropriation. But it had not been attached importance really in the fields of law practice and law study. The typical example was that we had used the "land requisition "to replace the "land expropriation ", which was not just the mixture between these two concepts, in fact, it reflected some mistakes on ideas. But just because of the mistake, as one direct cause, it brought about the chaos in land expropriation practices and studies. Recently, some scholars has begin to inquired into the system of land expropriation, but they almost paid attention to the compensation system on land expropriation only, and had not discussed the basic system detailed, including the basic concept, the characteristic and the quality on land expropriation. The article discusses the system of land expropriation just from the basic system, basing on the present situation of land expropriation in our China, and applying the methods of testing analysis and comparing analysis. By analyzing and inquiring, it tries to give some advices to develop and perfect the system of land expropriation in our China.
