Green trade barrier is the new direction of up-to-date international tradedevelopment and another non-tariff barrier that coming. Many countries in theworld utilize the Green trade barrier to limit the input of foreign products,having definite discrimination; but, Green trade barrier also has positive aspect,it protects our entironment. So, we should look on the Green trade barrierroundly, adopting measures positively, promoting the development of ourforeign trade, in base of our situation of our country.I. Causing of the Green trade barrierConsulting WTO's definition about Green trade barrier and combining itscharacteristic, this article considers that Green trade barrier is a kind oftechnical trade barrier, limiting or prohibiting imports of products that they fallshort of the international and domestic law,statute and criterion about naturalresource and entironment ,human and health egis of propagation ininternational trade, basing international pact,rule of law,criterion thatprotecting resource and environment and import countris'environment law,statute and standard.II. Content of the Green trade barrierThis article considers three angles to discuss the content of the Greentrade barrier, viz. basal form,basal structure and basal trait.The basal form includes green technical barrier,green environmentstandard,green sanitation quarantine system,green packing system,greentariff and market admittance,green subsidy,green process and productionmethod standard seven aspects.The basal structure is made up of three basal lamella structures, viz.international clause arising the green trade barrier,territorial regulation andcountry green barrier.The basal trait includes four aspects, viz. validity and concealment,discrimination and inequity,universality and conjunction,temporal effect andexpansibility.III. The economy effect analysis of the Green trade barrieri. Tariff substituting effect One side, the influence that green barrier measures to corporations ofexport country is negative, because the use of technical standard ,environmental standard and sanitation quarantine system causes product costincreasing of export enterprises, distorts original resource scheme in point,reduces production benefit. Considering the product cost, product costincreases , then products'supply decreases, the price of export products rises,at last export enterprises lose advantage and lose competitive force. The greenbarrier induces some tariff effect at first hand.On the other hand, the Green trade barrier can cause positive influence tothe production of same industries in import country. When export countries arefaced with ingoing obstacle, the same industries of import country will faceless competition than before, with the other condition same, admittanceobstacle that Green trade barrier including is more strong, the profit effect ofmeasures is more obvious, then tariff import substituting effect is also moreobvious.ii. Restraining effectThe green trade barrier mainly puts into practice double control , pricecontrol and quantity control. It cumbers the product's import. The restrainingeffect is consisted of price control and quantity control, above all, we analyzeit in static state; at last, we can analyze restraining effect in dynamic state, viz.dynamic restraining effect.IV. The Green trade barrier in WTO's rulesThere are many Green trade barrier problems in WTO's rules, the articlediscusses them in detail.i. The basal principle of trade and environment's rules in WTOIn WTO's frame, the basal principle and rule of trade and environmentare mainly embodied by three aspects. One, it must have legal target when thenumber countries adopt the Green trade barrier; two, the number countriesmust comply with the basal principle of WTO; finally, they must comply withfour rules when they adopt the Green trade barrier.ii. Agreement On Technical Barriers to Trade in WTOTBT means one country adopts functional and technical measures oftechnical statute,standard and eligible assessing program in order to vindicatebasal security of his country, to ensure health and safety of human andpropagation, to protect environment, to guarantee the quality of export product,to prevent deceptive behavior, and so on. All these measures form barrierswhen other countries'product enters its market.iii. Agreement On Sanitation and Plant Sanitation Measures in WTOSPS are some international rules of inspection and quarantine in importand export about propagation,product and food of propagation , includingfourteen clauses and three accessories. The number country adopts themeasure to protect health or life of human and propagation.iv. Correlative agreements with WTOIt includes the twentieth clause in GATT, Agreement on Establishing theWorld Trade Organization, Decision on Trade and Environment, Agreement onSubsidies and Countervailing Measures, Agreement on Agriculture,Agreement on Trade-Related Intellectual Property Rights, and so on.V.
