On Chinese Traditional Household-ethics Legal Culture And Its Contemporary Value

We are confronting an era of acute revolutions and so many conflicts. The conflict between traditional and modernity brings plenty of troubles and annoyances. In all these revolutions, family revolution is most significant. Now, modern law system has become the main social regulatory pattern, in place of religion, ethics, and morality. However, modern law system is not so perfect in function, so there are so much bewildering in family field. The article choose family field as an aspect, intending to analyze these basic problems, such as legal aims' achieving and the relation among law, morality, and ethics.Legal culture has been a field, which is noticed by law science. As a new research meaning, legal culture has some characters, for example, it reviews problems from wide background, its content is very rich. In history process of Chinese civilization, traditional culture has formed some characters, such as core status of family, and emphasizing household-ethics and sympathy of interpersonal relations. All these characters in traditional culture had ever affected the development of traditional legal system, and form a sub-system of traditional legal culture. We call the sub-system as traditional household-ethics legal culture. Nowadays, research about household-ethics legal culture is focusing on macro theory. The article analyzes culture base, regulation system, effect function and value principle of traditional household-ethics legal culture, aiming to do some contributions for concerned research.Firstly, the article analyzes household-ethics' culture base from Chinese traditional culture, aiming to explaining its social connotation, then analyzes the conception and structure of traditional household-ethics legal culture.
