Research On The Legislation Of Chinese Forest Certification

Forest certification originates in the 1990s and develops rapidly as a market-based instrument of promoting sustainable forest management. Forest certification is the process which carried out by the independent and authoritative third party , following the internationally well-accepted principles and standards of sustainable forest management , assessing and appraising the forest management achievement of forest proprietors ,and issuing the certificates to the eligible as a result. As one of the effective management tools , forest certification mechanism has been well accepted in the world.At present, the forestry of our country is at crucial period that transits from the traditional forestry to the modern forestry, facing enormous challenge in line with international standards after the accession to the WTO at the same time . Developing the forest certification , is the essential component of Chinese forest management in line with international standards , as well as the important impetuses to forestry's great-leap-forward development. Because forest certification is still at the beginning stage in our country, the basic research link is weak ,and didn't have got extensive recognition yet. So this paper has very important realistic meanings on combining our country's conditions and launching forest authentication research work.On the basis of extensively collecting large amount of documents, first of all, the paper makes brief summary to basic theories of forest certification and emphasizes its importance for promoting sustainable development of forest. Secondly , from the legal point of view ,the paper makes creative research on proving to necessity and feasibility of legislation of Chinese forest certification , offering the objective basis and theoretical foundation for constructing the forest certification jural condition of our country from the aspects of sustainable development , ecological ethics , legal function and legal origin.Finally ,the main purpose and innovation of the paper is to put forward the new idea of constructing forest certification legislative frame in the aspects of legislative model, legal relationship , jural institution and control framework ; in order to erect a set of integrated forest certification jurisprudence that is applicable to the condition of our country, which can establishing the legal status in China.
