Research On China's Natural Forest Protection Legislation

Human economic development has to go through three stages,from labor and resource economy,to finally reaching the intellectual economy.China has long been in the stage of relying on resources to develop the economy and relying on natural resources to promote economic growth.In the economic development of our country,natural forests have suffered unreasonable harvesting as natural resources.Since the 1950s,the natural forest area that has been harvested in the country is about 11 billion cubic meters,which has led to a sharp decline in the natural forest resources in China.For a long time,the harvesting and irrational development of natural forest resources have caused the quality of natural forest resources to decline drastically,and the environmental conditions in China have deteriorated and become fragile.Natural forests are a major component of China's forests and play a particularly important role in maintaining ecosystem security and promoting socio-economic development.In the new era,China has put forward new requirements for the protection of natural forest resources,requiring us to pay more attention to the role of natural forest resources in ecological security.In his report to the 19th National Congress of the Communist Party of China,General Secretary Xi pointed out that the natural forest protection system should be improved and all natural forests should be protected.The protection of natural forest resources is an important part of building an ecological civilization in China.It is urgent to obtain effective protection of the law.However,China currently lacks a special natural forest protection law.Only one of the current "Forest Law" is about natural forests.The provisions of protection lack specific operability.At present,China's natural forest-related legislation is mostly manifested in the early regulations and normative documents promulgated by the national forestry and grassroots departments,as well as local regulations and departmental regulations formulated and promulgated by various localities.These regulations and regulations basically cover all aspects of natural forest protection,providing comprehensive support and guarantee for the smooth implementation of natural forest protection projects and the completion of the expected goals of natural forest protection projects.However,it is undeniable that there are many deficiencies in the regulations and normative documents of the relevant departments of natural forest protection.If the scope of protection cannot cover the natural forests of the country,the legislative content is not consistent with its superior law,the local legislation is inconsistent with the departmental regulations,the inconsistencies between local legislation and the lower legal ranks.At the same time,the status quo of China's natural forest resources and the ecological and environmental problems caused by it also require China to protect all natural forests through legislation.Promoting natural forest protection legislation has become one of the important tasks of ecological civilization construction.Natural forest protection legislation has already had a certain theoretical basis in China,and it has certain feasibility,and it has also been unanimously recognized by the practical and theoretical circles.Taking into account the particularity and importance of natural forest resources in forest resources,according to the Forest Law,the formulation of the Natural Forest Protection Regulations is more scientific and reasonable,and can also play a role in making up for the shortcomings of the current Forest Law.Thereby constructing a system that is exclusive to the protection of natural forests.As far as natural forest protection legislation is concerned,its legislative purpose should make up for the shortcomings of forest law,that is,natural forest protection legislation should uphold the concept of sustainable development is the purpose of legislation.The ecological,social and economic benefits of natural forests make us realize that only by protecting natural forests can we achieve the unity of ecological,social and economic benefits.Under the legislative purpose of sustainable development,natural forest protection should also follow the basic principles of government-led,public participation,protection priority,rational use,responsible person responsibility,natural restoration,and artificial recovery.Regarding the protection of natural forests,the main contents include:first,the scope of protection of natural forests should be clarified;second,the responsibility and authority of governments at all levels in the investigation and planning of natural forests should be clarified;and third,establish a natural forest protection system to strengthen the restoration of natural forests;fourth,establish natural forest resources Rational use of the system;Fifth,establish a compensation mechanism for ecological benefits of natural forest protection,encourage the development of natural forest insurance business;sixth,implement the system of protect all natural forests,China's protection of natural forest resources is more and more extensive and deep.However,whether it is the natural forest resources project or some policies,the planning period is far from the time required to restore natural forest resources.Moreover,China must protect natural forests at this stage and for a long time to come.Therefore,it is necessary to speed up the
