A Global Legal Approach For The Protection Of Rights To Development

Based on the new trend of global political climate, this article explores the shortcoming of traditional paradigm of rights to development, and put forward a amended approach for global legal protection of rights for developments.The first section points out that at the era of globalization, the traditional paradigm is confronting many challenges which comes at one hand from the conflicts accompanying the course of globalization ,at the other hand from the reaction of developing country and developed country ,such as terrorism and unilateralism. In order to settle the disputes about the old model, a new global legal approach for the protection of rights for development is needed.The second part explains the characters of the new approach, which not only means the breakthrough of development economics, but also sheds new light for the protection of rights to development. This approach calls for the cooperation among govermnerts and emphasis the functions of global human righs organization.The third section puts forward the aims of this new approach .Firstly ,by explains the limitation of sovereignty theory at the global human righs issues, this airticle based this new paradigm on international political justice. Secondly, by comparing the different out coming of "liberal economy" and "autonomy of economy" at the current trend of globalization, the article believed that the core of this new paradigm is "autonomy of economy". Thirdly, the ultimate end of this new paradigm is to fight back the cultural hegemony and peruse the freedom of ethical identity.
