Study On The Legislation Of The Environmental Justice In America

For a long time, justice is a basic conception of sociology, politics and ethics. Now the idea of justice is brought into environment management, the notion of environment justice was posed. The research of environment justice came up first in America .At present, environment justice has become a law idea which is accepted widespreadly in American. It has a embryonic form of a very important law system especially after the issuing of Executive Order 12898( Federal Actions to Address Environmental Justice in Minority and Low Income Populations 1994) In the article;the author attempts to probe into the meaning of the environment justice in America ,introduce its legislation and implement, sum up its experiences and suggest some ways to perfect China environmental law by the way of semantic analysis,the way of historical analysis and the way of comparison analysis.In chapter one ,at first the author focus on the meaning of the environmental justice and points out that the environmental justice includes intragenerational justice and intergenerational justice which is pursue environmental distributive justice and political justice. Then the author discuss on the social value of the environmental justice .And at the last, the author holds that the environmental justice is the center assignment of the idea of sustainable development.The chapter two is concerned about the legislation of the environmental justice in American. Firstly, the author introduces the legislation condition of the environmental justice in American on the American of federal constitution of Equal Protection litigation,Title VI of Civil RightsAct of 1964,Executive Order 12898( Federal Actions to Address Environmental Justice in Minority and Low Income Populations) and National Environmental Policy Act or regulations .Secondly, the author analyze the main means of implement of the environmental justice in American, including Public Notice and Participation Requirements,Avai-lable nformation,Legal Tools and so on.In chapter three, by basing on analyses and evaluation the legislation of the environmental justice in American, the author gives some advice on how to perfect the system of China's environmental law: to establish and perfect the mechanism of compensation, to make up the legislation of environmental procedure, to establish the lawsuit institution of public good, and so on.
