The Study On The Value Trend Of Environmental Legislation Under The Idea Of Sustainable Development

This text analyzed the aim of environment legislation, concluded and summarized the values that influenced the modern environment legislation, demonstrated and clarified the inclined value of the modern environment legislation and its scientific nature and rationality. The aim of environment legislation is the general value and mission of the law that legislated by the legislator. In the course of legislation, the enactment of the aim is the most important. It materializes the value view of environment legislation, and this value view supports the establishment of environment legislation's steering idea , principle and system. Though the development of environment legislation at a certain extent depends on the society force, in the past, environment legislation uses the traditional view of value which controlled by"the centralized interest of humankind", which resulted in the aim of the environment legislation only focused on protecting humankind's interest. The environment legislation that based on this valuation doesn't match the ethic idea of sustainable development and modern environment. I think, under the promotion of the global environment crisis, nature, human and social science research, on the basis of modern environment ethic idea and the value requirement, at the lead of sustainable development view, the valuation of humankind's environment legislation is changing from"the centralized interest of humankind"to"the centralized interest of zoology". On this basis, I compared and analyzed several typical nations's environment legislation aims, and concluded modern environment legislation is heading for the direction of protecting environment and the sustainable development of human society under the new valuation of environment ethic. However, the steering idea of our environment legislation is still controlled by traditional valuation ethic. It is only environment protectionism. It can not cope with the idea of environment development, and deviate from the tidal current of international environment legislation, so now we must alter our aim of environment legislation.Therefore, I think our valuation of environment legislation should be based on environment ethic and lead by"the centralized interest of zoology"which influenced by sustainable development. From this, our valuation of environment legislation should establish the fair goal of environment legislation, under the premise that includes the centralized interest of zoology, so that, it can implement the equity within generation, between generations, and the equal rights based on species equity.
