On Protecting Rights Of The Employment About The Disabled From Comparative And International Law

There are more than 600,000,000 disabled people in the world, their life is frequently restricted with the bodily barrier, and the disabled frequently encounter the discrimination for the ignorance and prejudice of the common. But the employment of the disabled is a question which any society is unable to avoid. For helping the disabled participate in the society and creating the equal condition on labor and employment are the duties that the entire society cannot neglect. And it is the tendency that human society protects the disadvantaged group through the law as well.The purpose of this article is for researching the protection about the international law concerning with the right of the labor and employment of the disabled through using the comparative methods. The article is divided into four parts altogether.First, this article begins from the definition of the "disability" and relative basic conceptions, introducing the legal limitation to the right of labor and employment about the disabled, the vicissitude of the attitude to the disabled in the human society. At present, the manner that the human society treats the disability and disabled has been developed into "the disabled right pattern stage". And in fact the right of labor and employment of the disabled is one kind of that about equality and the society assistance.Next, from the three aspects of the developed country, the developing nation and the United Nations, the article introduces concretely the present situation of international legal protection according to the right of labor and employment about the disabled. Internationalsociety does not has one special international convention to protect the right of the disabled, but the every country and the United Nations are formulating the international convention about theirs. But in domestic, the developed country is better than the developing nation in the protection to the right of labor and employment about the disabled.Then, from the viewpoint of the international law, the article introduces the international legal way of current international society concerning with the right of labor and employment about the disabled. Also from the viewpoint of the comparison, and three aspects about the legislation, promotion of the right of labor and employment about the disabled, and eliminating the discrimination of the disabled, this article researches the domestic legal methods of each country for protecting that. And through banding the national conditions of our country, it also gives suggestions on above three aspects.Finally, the article gives the forecasting to the legal tendency of protecting the right of labor and employment about the disabled. At last, the article points out three developing tendencies of protecting the right of labor and employment about the disabled.
