Legal Research For Low Living Security System Of China's Farmers

Three agricultural issue has always been related to the overall situation of China's reform, opening up and modernization of the major issues, no rural area stability, there is no national stability. And the existence of rural poverty to some extent become a disturbing factor to the potential social stability. From this perspective with social security, the search for a solution to rural poverty basic survival issues, effective ways of maintaining social stability, China's rural residents that the establishment of minimum livelihood guarantee system, and on to the legal dimension. The paper comprises three parts :Part I, From the concepts and features of rural residents from the minimum livelihood guarantee system, we analyzed two sets of the dialectical relationship between the concept of relevant, while similar systems abroad have done a comparative analysis, resulting in the establishment of rural minimum living expenses for the system useful experience. And further elaborated on the establishment of rural minimum living guarantee system theories.Part II, From the perspective of empirical analysis,the paper promoted that the China's rural residents on the specific minimum livelihood guarantee system of the status quo, and to establish the necessary and feasibility of the system made more detailed, comprehensive analysis.The third part, the paper suggested that the rural minimum living guarantee system with the principle of legal regulation system for the establishment of the specific content of the system as minimal assurance target identification, minimal assurance standard scientific identification, financing and monitoring of minimal assurance management, and supporting the reform of the system of measures to specific aspects such as exposition.Finally, this paper tried to seeks to use economic-law knowledge, theory and methods to explore the relationship between economic development and social stability in rural minimum living expenses, and ardent desire of the system across the whole country to establish this area of the law soon.
