Study Of Anti-corruption In Transfer-system Period

According to the severity condition of corruption recent years in China, the article analyzes the root cause and damage of corruption. Versus the successful experience of abroad anti-corruption discuss the methods of anti-corruption in our country. The author thinks that the corruption is resulted in the fabrics of public power and selfish desire and the personality is so weak when encountered by goodness. Neither by the leader, nor by the honest and upright officer has any effective and only by law. Our country has pushed its way by law for anti-corruption, but we are still far from the goal, the corruption occurring more often and more frequently. It is the important reason that the law has "vacuum belt"and can't do it powerfully. We haven't established the social relationship rely on the law highest authority, the anti-corruption system are not the sound one, the public power aggressive the law, the anti-corruption department lacks legal authority and so on. If these problems are not resolved, corruption problem will not be settled easily. All the leaders of CCP who thoughts give the prosperous to China have attached great importance to corruption and we can learn a lot from the successful experience abroad. We would overcome the corruption successfully under the excellent socialism system. In the article, the author thinks that we should stress on the aspects as following: First, set up a perfect lawful system of anti-corruption. In the system, constitution is the first level, criminal law and criminal procedure law are the second level and some of special laws are the third level. The system should have strongly defensive and punitive and educational function make the national servants can't do corruption and don't dare corruption and don't want corruption. For example we should make a law regulate behaves of state officer include their power, rights, honest and duty. So we can use the weapon of law defeat corruption. Secondly, intensify strengthen on punishing corruption, stress on "three organs and one department"etc the frontier of opening. Try a new way and use advanced technology to handle the case. Enforce the independency of handling the case. Thirdly, strengthen independence and authority of special anti-corruption department by law and given necessary empower to ensure that they can do their duty objectively and justly and they must highly disciplined under the work standard and the core of power department will review their performance continuously. Finally, the author thinks that anti-corruption practice by law and not rule by law, this is the fundamental. On the contrary anti-corruption will be an empty talk. The article assimilates the reasonable point of some others'in recent years. After further discussion and study, expect it may be helpful and providing reference for research and practice of anti-corruption.
