A Study On The Implementation Of Intellectual Property Rights Strategy

With the speeding up of economic globalization, the creation, occupation and utilization of intellectual property rights have become the key factors for a country to achieve the competitive advantages and improve the overall national strength. After twenty more years since the reform and opening up, China has basically established the intellectual property legal framework geared to the international custom and fit for Chinese economic and social development level, adopted the intellectual property protection model featuring "the two paths, i.e., administrative and judicial measures, act together", initially building the planning and coordinating systems of IPR protection, launched the special IPR protection campaign, and cracked down on the IPR crimes severely. With these efforts, China has gone through the process that developed countries have passed with several hundreds of years. The success China has made is known to the world. However, because of the ever strengthening of international IPR protection system, the durable pressure from the USA, European countries and Japan, the continually enhancing of the IPR deployment of transnational companies in China, the ignorance of IPR protection awareness of public, the lack of overall IPR protection strategy, the weak points still existing in the laws and regulations, and the law enforcement capacity incapable of deterring the flooding IPR infringements and crimes, the situation of China's IPR protection becomes more and more serious.In this paper, we'll start from the concept, characters, scope and importance of IPR protection, through the concrete analysis of the birth of IPR system and the development of international IPR protection, especially from the development process of IPR protection of the USA, European countries, Japan and Hong Kong, we'll draw some lessons beneficial to China. Then we outline the success and situation of China's IPR protection, point out the existing problems. In the last part, we'll raised the policy suggestions for China to implement IPR strategy, which includes that the Chinese government should confirm the position of "protecting IPR mainly from the benefits of China herself, strengthening theresearch of IPR protection, fastening the construction of IPR laws and regulations with Chinese characteristics, highlighting the IPR law enforcement, guiding and aiding enterprises in strengthening IPR protection to improve the capacity and level of applying IPR systems.There have been already a lot of research results about intellectual property protection strategy in our country, this text does one's utmost to pinpoint the problems from the new angle on the basis of already having research results, possible innovation as follows, 1, have done analysis to the historical evolution of legal system of international intellectual property protection, have remedied the deficiency in present research to a certain extent. 2, have analysed and compared the intellectual property protection development courses of such four countries and regions as U.S.A. , Europe , Japan , Hong Kong ,etc, have remedied the shortcoming with more insufficient international experience while studying at present to a certain extent. 3, has pointed out the question existing in the present protection work of intellectual property right of our country, offer reference for the fact that the strategy of intellectual property protection of our country is built. 4, have promoted nine suggestion , intellectual property protection of strategy to propose , suit of our country intellectual property protection strategy of national conditions offer directionality guidance establishing.
