| National Science and Technology Planning Project (NSTPP) reflect the willpower of a country. It's related to the implementation of national economy and strategy object of society development. It's one of important work the government supports the development of science and technology. The management of NSTPP carrying out the contract is a significant reform of the way of the government's science and technology management. The way of science and technology management department managing undertaker of the project have changed from instruction to contract, and it makes the responsibility, right, and obligation clearer between the management and the project undertaker. The establishment of contract system in the management of NSTPP is good to regulating the management activity, protecting the right of the project undertaker and science research person, and mobilizing the positivity of the undertaker. As with the deepening reform of the science and technology system, the utilizing of the NSTPP will become widespread. However, people pay less attention to the legal effect of the NSTPP contract in current situation, many people still don't regard it as a law system, which has affecting its function. The article analyze the legal relationship of NSTPP contract from the law system's point of view by utilizing the related theory of administrative law and contract law, exploring the potential problems existing in the contract signing and implementation process and putting forward some suggestions, analyzing the responsibility of violation of the contract and law redress, proposing the new construction tot the form of law violation. In author's opinion, NSTPP contract as a legal system is a branch of administrative contract, the perfect of NSTPP contract system can't separate from the development of administrative contract theory and the perfect of legislation, so it's necessary to make specialized administrative contract law and incorporate the NSTPP contract into the regulation.
