Energy is an important physical base for the development of humanity economic society, energy is also the important material guarantee for state economy and social security. Without the sustainable development of energy, the sustainable development of economy and society is impossible to realize. The speeding up of China's industrialization proposed a higher request for energy production and consumption;China has already become the large energy production and consumption nation. Predicting on the basis of the present energy consumption, China needs energy of more than 3.2 billion tons standard coals in 2020, the energy consumption increases more than 2.5 times compared with the year 2000. If China does not adopt the sustainable development energy strategy, in the near future, the energy mining, transformation and utility will have great influence on the environment, the public health, the world climatic change, the economic development, state energy security and so on.Many Western countries have chosen the way of energy, environment and economy sustainable development, makes every effort to maintain the continual development of economy, guarantee the energy supply security, strengthens the environmental protection and enhances the competitive ability under the premise of not increasing the total quantity of energy supply, In order to strengthen the energy management, establishes a stable, economical, clean, reliable, safe energy guarantee system, China also starts to implement the sustainable development energy strategy.The energy law can turn the request of energy strategy to feasible, effective and manipulable legal system by legal criterion, forms the stablebehavior mechanism for the energy strategy implementation. Therefore, the fundmentality to realize the sustainable energy strategy of our country depends on the perfect degree of the energy law.This article starts from the analysis of Chinese current energy utility situation and the problem existing, introduces the international related energy legislation and the influence to energy legislation of our country, and proposes suggestions on the energy legislation by using for reference of overseas energy policy and the advanced experience in legislation and the system, hoping to establish an optimized energy structure and the economized energy consumption mechanism under the legal system environment, to speed up the energy technology advancement, to coordinate the relations of resources, environment and economic development, to solve a series of problems which the energy supplies faced to guarantee the energy demands of Chinese modernization.
