Setting Up The Value

Under the conditions of the increasing environmental crisis nowadays, it becomes a worldwide and important problem to realize the reconciliation between human beings and nature. We ought to make efforts in many aspects in order to solve the contradiction between human beings and nature, therefore, it is quite instructive for us to finish the mediation and transformation of our traditional viewpoints of natural value (human—centralism). In modern society, morality and law are the extremely key regulation powers, they are playing the very important roles during the course of coordinating the relationship between human beings and nature. On the basis of such consideration, in this paper, we will go through the theories of environmental ethics and environmental law, analyzing the collision and integration between them, and what's more, we will inquire into the remedial ways and mechanism of resolving the contradiction between human beings and nature but remaining proper tensions for environmental ethics and environmental law.Natural value is made up of the extrinsic value (meeting the existence and development of mankind) and the intrinsic value (keeping the ecology itself a balance and development). To admit the intrinsic one, it is not only inexorable in theory, but also the objective requirement of environmental ethics. However, though natural value is not an obvious concept between the lines of environmental law, we still can unearth the viewpoint of it through the specialized environmental laws and their orders. So far, natural value mainly means the nature's instrumental value and economical one for human beings. Evidently, there are some collision on the problem of natural value between environmental ethics and environmental law, furthermore, it will produce negative effect if the tension is large aswell. In consideration of this, it is particularly significant for us to seek for the common points of settling natural value between environmental ethics and environmental law. Enclosing this core problem and on the base of standpoints about natural value in the thought history, this paper consists of four parts.In the first part, analyzing the being and development of environmental ethics. In the part, we see that the intension, the essence, the constituation and the characteristics and the viewpoints of environmental moralist, we can further understand the position and action of natural value in environmental ethics. In the second part, probing into the setting of natural value in environmental law. In the part, the concept of natural value doesn't put farward definitely, but we can explore the natural value which covered the environmental law interior through its development course, the goal and the essence and the contents of it and it's various orders. In the third part, compared with each other, clarifying the collision between environmental ethics and environmental law. And in the fourth part, we will search after the necessity and possibility of integration on the problem of natural value between environmental ethics and environmental law. And they are the new-rising cross subjects, each of them is playing an unreplacable role in the theory and practice of how to protect environment. Seeing that, we should try hard to bring into their advantages mutually, in addition, the integration between them is not only necessary, but also possible.
