The Study Of The Human Rights Protection Of Crime Suspects During The Invesgation Process In Our Country

The human rights protection of crime suspects during the crime suits is an important topic. The Police Office, which has the investigation rights authorized by the law of crime, is a double blades sword. It can not only be used for investigation legally but possibly invading the rights of suspects without constrains as well. Therefore, the law must give the suspects necessary rights so that they can balance the investigation rights of police office to some extent, and which can protect the suspects. The acticle is based on the analysis of national and international cases, by taking the method of foreign countries, providing some suggestions of protecting the crime suspects during the investigation process.The article is devided into 3 chapters. The 1st chapter is dealing with the main manifestation of invading suspects' rights in current criminal investigation activity in brief, and analyze the reason of these problems. The investigation staff of our police office always invaded the criminals' rights, that is not only because of their own personal quality, but because the investigation policy is not reasonably designed. Therefore, how to perfect and strengthen the system of protection of suspects is an important topic in today's reform of Law suit system during investigation process.The second chapter is dealing with the theory and practise of investigation procedure system in foreign countries. Through the introduction, we further describe the importance and neccesity of protecting the criminal suspects farely during the investigation process, so give the basis to chaper 3 of study of how to protect the suspects.The third chapter describes the contents of the protection of human rights for suspects in our country in detail. Firstly, from aspect of deepening the rights of the suspects, studing the suit system of suspects in protecting his own reasonable rights, and further to say the key of center of suspect body. Then, on the police officer's investigation restrains side, further limiting the overuse of investigation rights, providing the guarantee for suspects protection. Finally, on the perfect of police office relevant investigation system side, provide the investigaters an open,fair and good enviroment of how to protect the human rights of crime suspects.The last chapter is the conclusion of this article. From conclusion, the auther reiterate that we should emphasis the importance and necessity of protecting the crime suspects and also should establish a good system. only by that, we may change the mind of investigation and stick to the rule of "no-crime-assuption" principle, so that establish the good system to protect the suspects in China.The author is concerned with the following thoughts considering with this paper: being based on the main thinkings of protecting the human rights during the crime investigation process side, and on the absorbing the foreign countries' experience of crime body system, through taking our own national status in mind, to establish the context of human rights protections. During the study of protection of criminal's human right, we should not only emphasis the current law based, but also the constraints of the rights of police office to protect the suspects' lawful rights. Meanwhile, through the optimizing of suites system in investigation process, we should provide a good system dependant to the crime suspects.
