The Administrative Guidance In Public Order Management

As one kind of gentle administrative manage means, the administrative guidance has been broadly used in the economy and society administrative management, since 1930's. As far as Chinese government is concerned, under the background of setting up harmonious society, the public security agency should draw lessons from the advanced countries. They should not only use the compulsory means to manage public order, but also pay more attention to the administrative guidance such as suggestion, encourage, education, leading advice and consultation etc. Therefore, they can obtain more support and cooperation of the people, which will make their job easier.Firstly, this thesis emphasize the necessity and possibility of the usage of the administrative guidance in public order management. In addition, the public security agency should hold the relationship between the administrative guidance and the compulsory means, find the right position of the administrative guidance in public order management, otherwise, it will be inefficiently.Secondly, as a matter of fact, only with the operative and understandable work systems, can the administrative guidance be converted into the work result. The public security agency should set up a series of work systems such as public security telling system, public security forecast system, public order management suggestion system, public order management reward system etc, according to the factual circumstance in public order management, to strengthen the administrative guidance.Last not the least, the administrative guidance is still a new thing in Chinese administration law science study field, meanwhile, the public security agency do not understand and approve it very well. So making the administrative guidance to be used more broadly and efficiently, still needs more hardworking.
