The paper analyzes reasons of unduly completed buildings and problems of traditionally dealing with them ,then focuses on the feasibilities and the specific dealing-ways of settling unduly completed building projects on way of real estate trust .on the basis of the above, the paper discusses a series of law problems in carrying out real estate trust because of flaws of real estate industry ,trust system and stock market in China ,and then makes suggestions. In the end, according to investors'failure in financing which causes the break of developing finance , the paper proposes that trust corporations should play important role in financing and develop real estate investment trust to bring about division of labor that promotes the impossibility of success in project development to induce unduly completed buildings.The paper includes introduce and four chapters.The introduce explains significances on this study.The First chapter discusses the main causes to unduly completed buildings and traditional dealing ways. The author makes definition about unduly completed buildings , and thinks unduly completed buildings are different form common in-buildings so that we don't dealing with these problems by buildings negotiating. The characters of unduly completed buildings are analyzed , by which proves the values of unduly completed buildings. Then the author demonstrates the main traditional ways to this problem and comments on limitations of them..The second chapter analyzes feasibilities and advantages of trust dealing with unduly completed buildings. Beginning from analyzing the advantages of trust system, the author discusses the feasibilities and advantages of trust dealing with unduly completed buildings, and illustrates in detail trust designing and the points of attention in practice.The third chapter pay emphasis on the law problems in trust dealing with unduly completed buildings. Because of flaws of real estate industry , trust system and stock market in China, there are some problems in practice such as flaw of estate evaluation market, law problems in negotiating unduly completed buildings ,real estate market access problem, trust liability , trust registration, trust benefits taxation, trust connection exchange and information reveal ,and so on. On the ground of studying, the author explains his own ideas and designs.The forth chapter bring the prospect for specialization of real estate development market . The author thinks investors should take advantage of specialties in developing. So the financing should depend on special financing organization (that is trust corporations) which disperse risks of project development to induce unduly completed buildings. In the end, the author uses the real estate development mode abroad for reference to assume some suggestions in developing real estate investment trust (REIT)in China.
