In 1979, after our country restored the insurance service, our native insurance agent system also along with it was introduced and developed. In recent years the insurance agent industry develop rapidly in places such as Europe and America day after day, as well as in Japanese and Singapore, where it is especially active. Since this system was not born in China, in the transplanting and adoption process of the system, because of the limitation of the factors including history, culture, legal standard and system design, our country insurance agency system also appears some bad tendency in its development process such as moral risks and good faith crises.As an important component of the insurance practice, it is the crucial link in the procedures of signing contracts and settlement of claims, which must play a vital role. The discussion towards this system makes role sense to the development of Chinese insurance industry.Recent years, scholars in different fields pay attention on the research of the related insurance agency system, including the economic and the financial study aspect, also yielded the certain result in the legislation and the fundamental research, but often simplified the problem.This paper puts the insurance agent into different system framework, discuss. It compares agency principles originate from continental law system with that from common law system and discusses requisitions to insurance agency industry under two principles.
